HIGHPOINTS OF SOME RULES & REGULATIONS
(RELATING TO OWNERS & LESSEES)


Occupancy of Units by Owners
  • Owners shall use the unit for single family residence purposes.
  • Owners shall not make use of their unit, which would violate any law, ordinance or regulation of any governmental body.
  • Owners may not commit or permit any nuisance, immoral or illegal act in the unit or in or on the grounds.
  • Owners may have guests any time they are in residence. If the owner is absent, and the guests are not immediate family, lease rules apply.
  • Where a unit is owned by a corporation, or an entity, other than a natural person, by such person certified in writing to the Association as the "designated occupant" of the unit, the identity of which may be changed by the owner of the unit not more frequently than once each calendar year. If owner fails to make such designation, the Association shall assume the "designated occupant" to be the President of the Corporation or the first-named natural person of an other legal entity; or any person related by blood, marriage or legal adoption to an owner of the unit or, where applicable, to the designated occupant of the unit. For purposes of this section, these persons will be deemed to be grandparents, parents, children, grandchildren, brothers, sisters, in-laws, nephews, nieces, aunts and uncles.
  • Day guests must be accompanied at all times when using any Beachplace facility. Day guests are not allowed when an owner is not in residence.
  • All Day guest's names and planned arrivals must be called in to Security to inform the guards so their entrance can be assured.
  • There is a $100 occupancy fee for anyone other than the owner and their immediate family on all leases.
Occupancy of Units by Lessees
  • The minimum occupancy period for lessees is one month (30 days). If the lessee does not stay 30 days, then the unit may not be used by anyone other than the owner until the thirty-day period has elapsed.
  • Lessees may have overnight family or guests visit while they are in residence, however, occupancy may not exceed the maximum occupancy of two persons per bedroom, regardless of age or family status, i.e. two bedroom units are limited to four occupants and three bedroom units are limited to six occupants.
  • Day guests must be accompanied at all times when using any Beachplace facility. Day guests are not allowed when a lessee is not in residence.
  • All Day guest's names and planned arrivals must be called in to Security to inform the guards so their entrance can be assured.
  • There is a $100 fee for all leases. Leases must be received in the Management Office 10 days in advance of the lessee's arrival.
  • Leases are made to one person or a married couple. Additional occupants will be considered guests.
  • Lessees may not sublet the unit, and may not allow anyone to use the apartment in their absence.
  • Violations of any rule or regulations will result in future lease applications being denied or other suitable action as determined by the Board of Directors.
Beach Area
  • Beach furniture is for the exclusive use of Beachplace residents and their accompanied guests, and may not be used to store extra towels, beach bags or other material
  • Beach chairs lounges and umbrellas may not be reserved.
  • Beach users are responsible for returning chairs to the high ground. Chairs are not permitted in the Gulf waters. Do not remove chairs from the beach and do not take them south of the Building #9 crossover or North of building #1. Umbrellas and stands are not to be moved.
  • An attendant or lifeguard does not monitor the beach at Beachplace. Use it at your own risk. Never swim alone. The beach is public property up to the high water line.
  • Wash sand from feet, shoes and personal items when leaving the beach. Foot showers and hoses are available at each crossover. Tracking sand into the buildings damages the floors and other furnishings and exhibits extremely poor manners.
  • Open fires are prohibited on the beach. Cookouts on the beach are permitted as long as charcoal is used in some type of grill. (Town Code)
  • Topless sunbathing is against Longboat Key Town Codes.
Clubhouse
  • Children under the age of 18 are not permitted to use the room or TV unless accompanied by a parent. Unauthorized use of the clubhouse should be reported to security or pool attendant.
  • Other than a scheduled party or board meeting, the only foods allowed in the clubhouse are beverages and dry snacks (i.e. popcorn, peanuts, chips).
  • Bathing suits or bare feet are not permitted in the clubhouse.
  • The clubhouse is a non-smoking building.
Deliveries

All deliveries, moving vans and contractors, are limited to 8 a.m. - 5:00 p.m., Monday through Saturday. Elevators must be padded for all furniture, appliance deliveries and contractors. Arrangements for padding the elevator can be made by contacting the maintenance office. The maintenance office will arrange for the custodian on duty to pad the elevator. Owners will be held responsible for damage caused by delivery agents.

All rented items (cots, cribs, wheelchairs, etc.) may not be left in front of the doors of the building. Other arrangements should be made with rental companies if you will not be at home for pickup.


Entry to Units

The Association has the right to access a unit when maintenance, repair, or replace a portion of the common elements, or any portion of the unit to be maintained by the association, or to make emergency repairs in a unit to prevent further damage to common elements or another unit. All owners are required to provide one key to their unit to the office immediately following any key change. Keys will be stored in a locked safe in the Condominium Office.


Hurricane Safety

In the event of a hurricane, the Fire Department will issue an order when residents must evacuate. If a resident absolutely refuses evacuation, neither the Police nor the Fire Department will respond to a resident requiring help after refusing evacuation. Adequate notice will be given by the Fire Department for residents to gather a few belongings before leaving the island. Radio and television stations will provide the locations for shelter. All traffic must go south only. No one will be permitted to go north; it will be one way traffic, south only. Announcements will also be made via radio and television when it is all clear to return to the island.


Lost and Found

Notify the Management Office if you lose or find any article on the premises. If you lose or find anything at the pool or beach areas, please notify the pool attendant of any loss or any item you find.


Motorcycles

Motorcycles are not to be operated on the premises, except on the main access roads to and from they're assigned parking spaces. Motorcycles may be kept on the premises in assigned areas only. Motorcycle engines may not be revved up and must be operated with a muffler system in good operating condition.


Noise

Music and all other sounds, including radios and television must be kept at a reasonable level so as not to disturb other residents and shall be turned to a minimum volume between the hours of 11:00 p.m. and 8:00 am. Organs or electronically amplified musical instruments are not permitted. Loud conversations on balconies and common areas should be avoided, including bidding good night to departing guests. If it is late in the evening, it is recommended that residents bid their guests good night inside the unit.


Parking
  • Owners and lessees may park in the space(s) assigned to the unit they occupy. Under building and outside parking spaces is a limited common element and can only be used by the unit owner to whom the parking space is assigned.
  • Guests and additional vehicles must be parked in the spaces marked for GUEST.
Pets

Pets of any kind are not permitted on Beachplace property. The only exception is guide dogs which are protected under the Americans with Disabilities Act.

Picnic Area

  • A picnic area with gas grill is available next to the pool area & tennis courts for residents and their guests
  • The grill may be used between the hours of 12:00 Noon and 10:00 p.m.
  • Users are responsible for cleaning the grill and disposing of all trash.
  • Music must be kept at a reasonable level so as not to disturb others.
Pool and Clubhouse

The pool area is a high activity area. The rules are necessary for everyone to enjoy the activities and to promote the safety for all. Use of the pool is at the sole risk of the user. The pool is unguarded---swim at your own risk. Children 12 and under must be accompanied and supervised by an adult at all times. Children age three or under are not allowed in the main pool at any time, or for any reason. All users must be toilet trained and no diapers are allowed.

The SPA is restricted to those 18 years of age or older due to the 104+ degree water temperature. Pregnant women and anyone with high or low blood pressure or other heart problems are recommended to avoid use of the spa. Children under 18 years of age are not allowed in the spa. Wash sand from your feet and wash the tanning oil off by using the shower before entering the pool or spa.


Pool Rules

Allowed:
Kick board for exercise, noodles, arm bands, small inner tubes around waist, dive sticks and rings provided children are not throwing them across the pool and causing danger or creating havoc.


Tennis Area

Tennis hours are 8 am to 10 p.m. Lights go out automatically at 10 p.m., so please plan accordingly. Tennis courts are for the exclusive use of Beachplace residents and their invited guests. Reservations/registration is required during the October to May season. Players may reserve one court per unit, up to 24 hours in advance, through the pool attendant. Playing time is limited to one hour for singles and two hours for doubles. Players may not sign up for another time period while still engaged in play or when others are waiting for a court. The Beachplace staff cleans the courts each morning at 8 am. After that, players are responsible for sweeping courts. Equipment is available at the courts. Players must wear tennis shoes only. Any other type of footwear or bare feet is prohibited. Proper tennis attire is required. An emergency phone is located at the tennis pavilion. This is an intercom line only and will not dial out to units. The telephone will only call the Guardhouse, Maintenance or Management Office.
